QUESTION
In an extra-curial speech delivered at the 2020 Griffith Law School Michael Whincop Memorial
Lecture, Justice Patrick Keane of the High Court of Australia said the following:
The ubiquity of social media has exacerbated the stresses associated with intensive interaction between individuals. An active online presence is likely to mean finding oneself in heated disputes with people we do not know and may well have difficulty identifying… An absence of civility is characteristic of much of this communication. And there is confusion as to whether much of this debate should be regarded as a private or public activity.
Critically explore the issues raised in Justice Keane’s quote with specific and close reference to the underlying principles of liberalism that inform Australian public law.

[ANSWERED] Weekly discussion post 1 — Week 2:According to Whiting,…
Weekly discussion post 1
Week 2:
According to Whiting, what does a gender-based analysis of domestic abuse contribute to our understanding of same-sex abuse?
In Nel Whiting ‘s paper
“A Gendered Analysis and Same-Sex Domestic Abuse”
(2007) the main goal is to educate readers on the value and importance of gender-based analysis when aiming to understand domestic abuse in same-sex relationships. Whiting highlights various points on misinformation which results in a misunderstanding of past gender-based analysis and how we as society understand same-sex abuse. The first point the writer makes is that domestic abuse is not biased and based on gender if the abuse is also happening in same-sex relationships and households. The notion that violence is gendered stems from ones misunderstanding about the fundamentals of sex and gender. He also states that the belief that women are unable to be violent or use violence and that men cannot be victims of domestic abuse is dangerous and founded on hegemonic patriarchal misinterpretations about gender. While understanding gender’s role in domestic violence is very important, it is not the only category that defines abuse and domestic violence. Whiting also discusses some feminist theories that support the idea that gender is socially constructed, and that women and men are not naturally violent or aggressive, they become that way. The author states that the knowledge of heterosexuality being classed as the social norm has led to society’s warped understanding of gender and has allowed people to believe that gender only includes masculine men and feminine women. Whiting concludes that we can evaluate and understand same-sex abuse by also looking at how one grew up, how they were during their adolescents and the person they’ve become throughout adulthood. Whiting explains that the concept of gender-based analysis focuses on the whole circumstances of the violence and or abuse that not only looks at same-sex abuse but all multitudes of violence within all relationships. By understanding the main goal of gender based analysis, we are able to see a larger view point when facing domestic abuse that involves same-sex couples through incorporating and evaluating outside factors and experiences of women and men in heterosexual relationships, as well as the continually changing concept of ones gender and how their gender within society shapes what society considers normal.
